Probation Violations/Bond Hearings

Representation in Probation and Parole Violation Matters

You have the right to an attorney during a probation violation or bond hearing. These proceedings have an effect on your freedom and future. If you fail to abide by the conditions of probation, a judge will issue a warrant for your arrest. When the police arrest you, the judge usually will not set a violation of probation bond.  This means that you will have to have a hearing in front of the judge in order to have a bond set on violation of probation cases.

At Raisman & Raisman, P.A., our lawyers represent people in probation violation, parole violation, and bond hearings. With over 33 years of combined legal experience, our firm, located in Ft. Lauderdale, Florida, knows how important it is to act promptly when you or a family member faces an arrest. Probation and Parole Violations

The conditions of probation are complex. Almost anyone could become confused. If you violate a condition of your release, you could face a violation of probation (VOP) charge. Your probation officer will petition the court to issue a warrant for your arrest, and the court will hold you until you can come before the judge that sentenced you. Our attorneys will speak to the judge directly, petitioning them to release you until your probation violation or parole violation hearing.

Some of the reasons why the court finds people in violation of the conditions of their probation and parole include a failure to:

  • Remain law abiding / new arrest
  • Abstain from using drugs / positive urine
  • Remain in contact with their probation officer
  • Update contact information
  • Pay restitution or finish community service

Bond Hearings and Reductions

In some cases, the court will refuse to set a bond, or will set it at an extremely high amount. The court may even set a bond that a person cannot afford to pay. We will petition the court to reduce the amount based on a person's strong ties to the community, lack of a criminal record, and employment. For some more serious crimes or probation violations, the court will refuse to set bond. We will petition the court to set an amount of bond.
